Eucerin® Hyaluron-Filler + Elasticity Pop Quiz Giveaway (15/12/2020 to 31/12/2020)

Please read these Terms and Conditions carefully before you enter the Eucerin® Hyaluron-Filler + Elasticity Pop Quiz Giveaway. By entering, you are deemed to have accepted these Terms and Conditions and that you agree to abide by them. If you do not agree to these terms and conditions, please refrain from participating in this contest.

1. Contest Period

a. This Eucerin® Hyaluron-Filler + Elasticity Pop Quiz Giveaway (“Pop Quiz”) organised by Beiersdorf (Malaysia) Sdn Bhd. (“the Organizer”). The Contest begins from 16/12/2020 and ends on 31/12/2020 at 11.59 PM (“Contest Period”).

2. Eligibility

a. This Pop Quiz is open to all Malaysian citizens residing in Malaysia aged 18 and above (as at the date of participation in this Pop Quiz) holding valid Malaysian National Registration Identity Card only (“Participants”).

b. The following group of persons shall not be eligible to participate in the Pop Quiz: a. Employees of the Organiser including its affiliated and related companies and their immediate family members (children, parents, brothers and sisters, including spouses); and/or representatives, employees, servants and/or agents of advertising and/or promotion service providers of Organiser including its affiliated and related companies, and their immediate family members (children, parents, brothers and sisters including spouses).

3. How to Join

a. Like and follow Guardian Malaysia Facebook page & Eucerin® Malaysia Facebook page.

b. In the comment section, answer “What’s your main skin concern & why you want to win Eucerin® Eucerin® Hyaluron-Filler + Elasticity trial set ?”

4. Winners and Prizes

a. Prizes: TEN (10) sets of Eucerin® Hyaluron-Filler + Elasticity Trial Set worth RM125 each, inclusive of :

i. ONE (1) unit of Hyaluron-Filler+ Elasticity Day Cream 20ml

ii. ONE (1) unit of Eucerin® Hyaluron-Filler+ Elasticity Night Cream 20ml

b. TEN (10) winners will be selected based on a computerized random selection system. Each winner will receive ONE (1) set of Eucerin® Hyaluron-Filler + Elasticity Trial Set worth RM 125 each.

5. Disqualification

a. The Organiser reserves the right to disqualify and/or exclude Participants and/or revoke the Prize if: -

i. the Participant is ineligible or does not meet any of the eligibility criteria set out in the above; or

ii. the Participant does not provide the required details upon receiving the request/notification from the Organiser; or

iii. the Participant breaches the Terms and Conditions or other rules and regulations of the Pop Quiz or violated any applicable laws or regulations; or

iv. in the Organiser’s sole determination, it believes that the Participant has attempted to undermine the operation of the Pop Quiz by fraud, cheating or deception; or

v. Winners cannot be contacted after two attempts within reasonable intervals to contact via direct message on Facebook private message by the organiser.

b. In the event the disqualification take place after the announcement of winners, there will be no selection of replacement of the disqualified winner.

c. In the event of a disqualification after the Prize has been awarded, the Organiser reserves the right to demand for the return of the Prize or payment of its equivalent value from the disqualified Participant.

6. Prize redemption

a. Winners will be selected based on criteria determined by Beiersdorf Malaysia in its sole and absolute discretion.

b. We may opt to announce the results of the Contest in our social media page and/or other online platform own and operated by us (e.g., Eucerin® Facebook Page wall) within FOURTEEN (14) days after the end of Contest Period. We will notify the winner via private message on the Contest Page or via e-mail (whichever applicable) (“Notification”). In the Notification, we may ask for your personal information for verification purposes and/or to arrange for delivery of the prizes.

c. Each potential winner is responsible to respond to the Notification and provide their details (full name, date of birth, contact number, mailing address & e-mail address) within SEVEN (7) working days from the date of Notification. Failure to do so, prizes shall be forfeited or disposed of at the discretion of Beiersdorf Malaysia.

d. Beiersdorf Malaysia reserves the right to disqualify or reject, at its sole and absolute discretion, any contestants and/or revoke or forfeit any prizes at any stage of the Contest if Beiersdorf Malaysia is of the opinion that:

i. the contestant is not eligible in accordance to the terms herein stated;

ii. 2. the entries are incomplete and/or failure to comply with any of the Terms and Conditions;

iii. 3. the contestant breaches any of the Terms and Conditions or other rules and regulations of the Contest or violates any applicable laws or regulations;

iv. 4. the contestant has undermined or tampered or attempted to undermine or tamper the operation or process of the Contest in any way whatsoever, including but not limited to fraud, cheating or deception;

v. 5. the entries contain third party intellectual property rights that are used without prior consent from the rights holder;

1. the entries contain obscene, profane, vulgar, abusive, hateful, threatening, harassing, offensive or otherwise inappropriate language, imagery or material, including without limitation any message/image which contains (a) swearing; (b) comments or actions which appear to be discriminatory of any person, company or group of individuals, for example comments of a racist, sexist or homophobic nature; (c) sexual innuendo, sexual language or sexual acts, actions or gestures; (d) promoting any illegal unlawful activity such as drug use; (e) any message/image that appears to be an advertisement or solicitation to buy; and (f) any materials (whether written or visual) that directly or indirectly relate to Beiersdorf Malaysia competitors or that show any intention of promoting any brand other than Watsons Malaysia; or

vi. The profile is removed or deleted within the winner selection or contact process.

7. Privacy Notice

a. By participating in this Pop Quiz, all Participants agree and consent to allow their personal data being collected, processed and used by the Organiser in accordance to the Organiser’s Privacy Notice, which is made available at the Organiser’s website at facebook.

b. In addition, and without prejudice to the terms in the Organiser’s Privacy Notice, Participants agree and consent to their personal date or information being collected, processed and used by the Organiser for:

i. The purposes of this Pop Quiz and Giveaway;

ii. Marketing and promotional activities conducted in such manner as the Organiser see fit in any media including but not limited to any form of advertising or publicity media and materials such as audio and/or visual recordings published through newspapers, television networks, radio stations or online and digital media and on the Internet, without further express consent from the Participants. Marketing and promotion activities include without limitation the use and/or publication of any details provided in and/or in connection to the entries, as well responses and related photographs.

8. General Terms and Conditions

a. The Organiser reserves the right to amend the Terms and Conditions contained herein, where necessary for legal, technical or commercial reasons and any such amendments shall be effective upon posting on the Eucerin® Facebook page.

b. For avoidance of doubt, cancellation, termination or suspension of this Pop Quiz by the Organiser shall not entitle the Participants(s) to any claim or compensation against the Organiser for any and all losses or damages suffered or incurred by the Participants(s) as a direct or indirect result of the act of cancellation, termination or suspension.

c. The Organiser’s decision on all matters relating to this Pop Quiz, including but not limited to the eligibility to participate, the selection of the Participants for this Pop Quiz, shall be final and binding. No further correspondence, appeals, protests or attempts to dispute the same shall be entertained.

d. This Pop Quiz is not organised by or associated with Facebook. All Participants, however, agree to comply with all rules and regulations as may be imposed by Facebook in respect of any posting thereon.

e. Information provided by Participants will only be used for the fulfilment of this Pop Quiz and is provided for the Organiser only, not to Facebook.

f. The terms and condition herein shall be governed by and construed in accordance with the laws of Malaysia.
